General Conditions of Hire

1 The hire period shall be between the hours and days stated on the form headed

"Confirmation of Use and Final Receipt" issued by the Secretary on behalf of the Management Committee and the Trustees of the Centre.

2 The Hirer undertakes that members will not exceed the hire period.

3 In the event of the hire period being exceeded the Hirer undertakes to pay (at the option of the Management Committee) either an additional hiring fee calculated on the basis of the daily hire charge (from Mondays to Thursdays) or one half of the weekend rate (from Fridays to Sundays) per additional day or part of a day or, alternatively, such sums as shall have been lost by the Management Committee including any compensation paid or payable to any other hirer or hirers of the Centre resulting from the exceeding of the hire period.

4 The Hirer understands the prescribed arrangements for the collection and return of the keys and further understands that once the keys have been collected the hire period will be deemed to continue until such time as the keys are returned with the prescribed arrangements.

5 During the hire period (whether as provided in Condition 1 or as extended under Condition 4) the Hirer and the Party Leader shall be jointly and severally responsible for any damage whatever , which shall be suffered by the Centre or any of its contents or fittings (fair wear and tear excepted) and shall indemnify the Management Committee from all or any cost of repair or (at the option of the Committee) replacement necessitated wholly or partially by such damage.

6 The Hirer and the Party Leader shall at all times observe and perform and shall ensure at all times all the members of the Party shall observe and perform the rules of the Centre and any revisions thereof.

7 Neither the Trustees nor the Management Committee its members or officers shall be responsible or liable at law for any of the following;

(a) any loss suffered by anyone arising from any failure on the part of the Hirer or Party Leader to obtain the keys to the Centre save where there has been strict compliance with the prescribed arrangement for the collection of keys.

(b) the failure of all or any of the services at the Centre whether water, electricity, gas, fuel-oil or drains.

(c) any loss or damage whatsoever suffered which occurs within the Centre save for death or bodily injury to any person or persons which is caused by the negligence of the Trustees the Management Committee or its servants or agents.

8 Neither the trustees nor the Management Committee nor its servants or agents shall owe any duty of care towards any persons in the pursuance by them of any outdoor activity whatsoever and wheresoever and shall not be responsible for any loss or damage thereby suffered.

9 Both the Party Leader and the Hirer will take all reasonable steps to ensure the safety at all times of all or any persons using the Centre during the hire period whether extended or not and will ensure that all such persons comply with and observe the Rules of the Centre.

10 The total cost of the hire shall be paid in two parts. Firstly it shall be a condition of the acceptance of a booking that the Hirer pay a deposit of £50 within seven days of the date of the Booking Acceptance. Secondly, the balance shall be paid so as to be received by the Booking Secretary no later than the date indicated thereon. In the event of no deposit being received as provided there shall be no enforceable hiring agreement. In the event of the balance not being received as provided then the deposit shall be forfeit as liquidated damages for breach of contract.
